In 2025, each of WorkSafeNB’s compensation acts are scheduled for review as required by legislation. While the Workers’ Compensation (WC) Act was recently amended in two phases following recommendations from the 2020 legislative review, this next review gives us an opportunity to take a fresh look at additional areas.
This review will primarily focus on how the WC Act addresses compensable stress, including:
Exploring expanding beyond acute reaction to traumatic events
Exploring expanding permanent physical impairment (PPI) awards to also include awards for permanent psychological injuries
Reviewing the list of occupations included in the PTSD presumption
However, if there are other areas of concern that you’ve encountered in your work that you think deserve attention we want to hear from you.

This 30-day consultation phase is open for employee contributions. We’re gathering insights to help identify potential issues for legislative change — with a particular focus on compensable stress under the Workers’ Compensation Act.
Fall 2025 – Research and Analysis
this is an upcoming stage for Workers' Compensation Legislation – Staff Issues ID
Contributions to this consultation are closed for evaluation and review. The project team will review all input and conduct legal and policy analysis, reporting back on key findings and themes to the Executive Leadership Team by December 2025.
Spring 2026 – Public Consultations
this is an upcoming stage for Workers' Compensation Legislation – Staff Issues ID
After internal feedback is reviewed and considered, proposed legislative changes will be shared through a 90-day public consultation process. This phase invites feedback from external stakeholders including injured workers, employers, labour representatives and the public.
Dec. 2026 – Final Report to the Minister

A summary of feedback and recommendations for legislative change will be submitted to our board for approval, then included in a final report to the minister in December 2026.
