Why are we reviewing the legislation again?

    WorkSafeNB is required to review our governing legislation every five years. The changes from our last full review were introduced in two phases in 2024 and 2025. Those changes reflected the priorities set at that time. This review gives us a chance to revisit previously identified issues to see if they remain current and consider new concerns to help us prioritize our legislative recommendations for this review.

    Are all the compensation acts being reviewed?

    Yes. The Workers’ Compensation Act, Firefighters’ Compensation Act, Blind Workmen's Act, and Silicosis Compensation Act are all within the scope of the 2025 review. However, the primary focus will be on potential changes to compensable stress under the WC Act.

    Why focus on stress this time?

    During early planning, ELT agreed that psychological injuries under the Workers’ Compensation Act deserve focused attention. We're specifically looking at:

    • Stress beyond acute reactions to traumatic events

    • Permanent physical impairment (PPI) awards for psychological injuries

    • Expanding the PTSD presumption to other occupations

    What about the FIrefighters' Compensation Act?

    The Firefighters’ Compensation Act is included in the 2025 legislative review. A focused review of this Act is already underway, and public consultation has been completed. The board is currently considering next steps based on that feedback.

    What about the Blind Workers' Compensation Act?

    The Blind Workers' Compensation Act is still in force but has very limited use. No recommendations for legislative changes are expected as part of this review.

    What about the Silicosis Compensation Act?

    The Silicosis Compensation Act is still on the books but is no longer used as there are no ongoing claims. Its repeal is being considered as part of this review.
