What is the policy about?
WorkSafeNB is developing a new policy to guide decisions on claims involving “any other disablement”. Under the Workers’ Compensation Act, this term generally refers to disablements that are not tied to a single identifiable event and may develop gradually or involve multiple contributing factors.
These types of claims can include conditions such as heart attacks, strokes, or injuries that develop over time from repeated strain.
They are distinct from infectious diseases, which result from a single exposure, and occupational diseases, which are diseases peculiar to or characteristic of a particular industrial process, trade or occupation.
While WorkSafeNB has policies to assist with the decision making around some conditions such as infectious diseases and occupational diseases, there is not a specific one on “any other disablement”. Currently, to make decisions involving “any other disablement”, WorkSafeNB uses the broad decision-making policy, Conditions for Entitlement - General Principles.
This new policy will:
Set out a clearer decision-making process for “any other disablement”; and
Support consistent and transparent decision-making.
